Mike Tadych and Amanda Martin won summary judgment against Chatham County Board of Elections

In September, EGHS partners Mike Tadych and Amanda Martin won summary judgment against the Chatham County Board of Elections on behalf of two Chatham County residents who sued under North Carolina’s Open Meetings and Public Records Laws.  The Chatham citizens brought suit after discovering that the Board of Elections held a series of illegal meetings and then denied records of the meetings when requested.  Special Superior Court Judge John W. Smith found that the Board’s conduct violated both the Public Records Law and the Open Meetings Law; ordered the Board to generate records of a meeting where no records were kept; to comply with the laws in the future; and ordered the Board to retain and make available for public inspection all preliminary or working materials used to create minutes of Board meetings, in addition to the minutes themselves.
