Construction Law and Litigation

Everett, Gaskins, Hancock & Stevens’ attorneys deal with a variety of legal issues arising out of construction projects, including design, financing and the construction process itself. The firm has represented architects, engineers, general contractors, specialty subcontractors, and construction managers as well as owners.

Ed Gaskins, the firm’s managing partner and senior litigator, tries construction-related cases in state and federal courts as he has for more than thirty years. He is a member of the American Bar Association’s Forum Committee on the Construction Industry and is a member of the Construction Section of the North Carolina Bar Association. He regularly consults with owners and contractors on construction issues and represents owners, contractors, and design professionals in litigation and arbitration. His longest trial (eight months) resulted in a multi-million dollar judgment in favor of a specialty subcontractor against the United States government.

Mike Tadych, one of Ed's partners, also represents businesses and individuals in construction-related disputes. Earlier this year, Mike successfully pursued homeowners who refused to pay for significant work on a home they own and who failed to close on the purchase of real property related to the parties' business by obtaining a significant jury verdict on behalf of the general contractor who did the work. Mike construction law representations include: private homeowners in their claims against a builder for misapplication of Exterior Insulating and Finishing System (EIFS), also known as synthetic stucco; claims against a waterproofing company for its ineffective installation of crawlspace waterproofing; and teaming with former EGHS partner, Paul Ridgeway to help a Florida hauling company collect payments from a Corp of Engineers contractor for clean-up work following Hurricane Fran's devastation of the Research Triangle area. More routinely, Mike represents construction and design subcontractors working to preserve and enforce their lien claims on construction projects to get them paid.

Ed and Mike periodically combine their construction law experience to come to the aid of North Carolina property owners experiencing significant problems with toxic mold due to construction defects and repairs. The pair use their experience to work with engineers, mycologists (mold scientists), certified industrial hygienists, remediation professionals, insurance companies and others to analyze, document and oversee the repair and clean-up of toxic mold and the effects of mold exposure.
