Bankruptcy and Insolvency

Under the leadership of partner Bill Janvier, a Board Certified Specialist in Business and Consumer Bankruptcy, EGHS attorneys regularly assist both businesses and individuals experiencing financial distress, as well as creditors who are owed money by financially distressed companies. Bill, who also has served as a Chapter 7 Bankruptcy Trustee in the Eastern District of North Carolina, has advised a wide variety of businesses (including retail stores, manufacturing concerns, builders, health care providers, and technology companies) in successful Chapter 11 reorganizations and out of court workouts. Bill also regularly represents individuals in financial distress, unsecured creditor committees, and creditors of insolvent companies. He has both instituted and defended hundreds of Adversary Proceedings seeking the return of preferential payments and fraudulent conveyances, and is a frequent writer and speaker on bankruptcy and related issues.

Ed Gaskins, our firm’s managing partner, has practiced before the federal bankruptcy courts since their creation in 1978. He has represented debtors and creditors in several of the largest bankruptcies filed in North Carolina.

Mike Tadych regularly represents secured creditors and floor plan lenders in all North Carolina courts and has successfully exercised pre- and post-judgment remedies to recover a wide variety of collateral for our clients.

Matt Vaughn has applied his extensive litigation experience in numerous fraud and transfer cases before the bankruptcy courts in the Eastern District of North Carolina.

Louis Wooten holds an L.L.M. in Taxation and is a former law clerk to Judge Robert Ruwe of the United States Tax Court. Louis has enjoyed enormous success negotiating with the IRS and the North Carolina Department of Revenue on behalf of EGHS clients.

Beth Soja, the firm’s newest associate will be working with Bill Janvier in the firm’s bankruptcy practice. She is admitted to practice in both North Carolina and Virginia.
